TL;DR
- The EU AI Act applies to Asian companies that place AI systems on the EU market or whose AI output is used in the EU.
- Most enterprise AI use cases will fall in the "limited" or "minimal" risk classes. The compliance burden is real but manageable.
- The work for Asian sellers concentrates on four steps: classify, document, conformity assess, and appoint an EU representative.
Why now
The EU AI Act entered into force on 1 August 2024 and applies in stages through 2027. As of mid-2026, prohibitions and AI literacy requirements are in force. General-purpose AI obligations are in force. High-risk system obligations apply from August 2026, with general application from August 2027.
For Asian companies, the question is not whether the Act applies. It often does, even where the company has no EU establishment. The European Commission's AI Act Implementation Q&A confirms extra-territorial application where AI output is used in the EU.[^1] Asian companies that ignore the Act may find their customers will not.
Who is in scope
The Act applies to:
- Providers that place AI systems on the EU market, regardless of where they are established
- Deployers of AI systems located in the EU
- Providers and deployers located outside the EU where the output of the AI system is used in the EU
- Importers, distributors, and authorised representatives
For an Asian B2B SaaS company selling AI-enabled software to a European customer, the company is typically a "provider" and may need an EU representative. For an Asian outsourcer running AI workflows on behalf of a European client, the company is a "deployer" with downstream obligations.
The four risk classes
The Act classifies AI systems into four tiers.
Unacceptable risk (prohibited). Examples: social scoring by public authorities, real-time biometric identification in public spaces (with narrow exceptions), AI exploiting vulnerabilities of specific groups. Most enterprise AI does not fall here.
High risk. AI used in: critical infrastructure, education, employment, essential private services (credit scoring, life and health insurance), law enforcement, migration, justice, democratic processes. Annex III lists the categories. Conformity assessment, registration, ongoing monitoring required.
Limited risk. AI systems with specific transparency obligations: chatbots, emotion recognition, biometric categorisation, generative AI producing content that resembles real persons. Disclosure to users required. Lower documentation burden than high-risk.
Minimal or no risk. Everything else. The vast majority of enterprise AI use cases (spam filters, recommendation engines, internal productivity tools) fall here. No specific obligations beyond voluntary codes of conduct.
For most Asian companies the practical question is whether their offering touches a high-risk category. If yes, the work is substantial. If no, the work is moderate.
What high-risk classification triggers
If your AI system is high risk, the obligations include:
- A risk management system across the AI lifecycle
- Data and data governance practices for training, validation, and testing data
- Technical documentation including system architecture, training methodology, performance metrics
- Record-keeping (logging) sufficient to enable post-market surveillance
- Transparency to deployers about capabilities and limitations
- Human oversight design enabling deployers to interpret and override outputs
- Accuracy, resilience, and cybersecurity meeting state-of-the-art standards
- Conformity assessment (often self-assessment for the early period; notified body assessment for some categories)
- Registration in the EU public database
- Post-market monitoring and reporting of serious incidents
The European Commission's joint AI Pact has documented that mid-size enterprises typically take 6-9 months and EUR 150,000-EUR 400,000 to bring a high-risk system into conformity.[^2] Plan accordingly.
What general-purpose AI obligations look like
General-purpose AI models (GPAI) have a separate obligation set. Providers must:
- Maintain technical documentation
- Provide information to downstream providers integrating the GPAI
- Comply with EU copyright law in training
- Publish a summary of training data sources
For "GPAI with systemic risk" (currently defined as models trained with computing power above 10^25 FLOPs), additional obligations apply: model evaluations, adversarial testing, incident reporting, cybersecurity protections.
For most Asian enterprise AI deployers, GPAI obligations apply indirectly: you consume GPAI from a provider (Anthropic, OpenAI, Mistral, regional providers) and inherit the documentation they provide to you. Keep their documentation in your compliance file.
Implementation playbook for an Asian seller
If you sell AI-enabled products into the EU, run this playbook now.
- Inventory your AI systems. Every system that uses AI to process EU customer data or produce output used in the EU. Be generous with the definition.
- Classify each system against Annex III. High risk, limited risk, or minimal? If unclear, document the analysis.
- For high-risk systems, scope the conformity work. Risk management system, technical documentation, data governance, logging, human oversight design, accuracy and cybersecurity. Six to nine months of work for a single system.
- For limited-risk systems, design the transparency disclosures. Chatbot users must know they are talking to a chatbot. Generated content must be marked.
- Appoint an EU representative. Required for providers without EU establishment. The representative is a legal entity in the EU that can be contacted by authorities.
- Update your contracts. Customer contracts should allocate responsibility, document permitted uses, and cover indemnification for misclassification.
- Subscribe to AI Office guidance. The European Commission's AI Office publishes interpretive guidance frequently. Assign one person to monitor.
Conformity assessment in practice
For most high-risk systems in Annex III, the conformity assessment is "internal control" (self-assessment) until at least 2027. The exceptions are biometric and certain critical infrastructure systems, which require a notified body.
Internal control means you (the provider) document conformity, declare it, and make the documentation available to authorities on request. You do not need a third-party audit. You do need:
- A complete technical file
- Evidence of testing against accuracy and resilience benchmarks
- Documentation of the risk management system
- Logs sufficient for post-market surveillance
Asian providers should not under-estimate the effort. The technical file alone is often 200-400 pages for a non-trivial system. Treat it as a documentation deliverable from the build phase, not a retrofit at launch.
What customers will ask you
Even before the high-risk obligations take full effect, EU customers are starting to ask Asian providers for AI Act readiness statements. The most common questions:
- Have you classified the system under the Act?
- Where is the technical file?
- Who is your EU representative?
- What logging do we get for our post-market surveillance obligations?
- How do you handle accuracy regression and drift?
Have answers ready. The procurement teams asking are not always experts. Their questionnaires will be imperfect. Answer the spirit, not the letter, and document your reasoning.
Counter-arguments
"We are not in the EU. The Act does not apply." The Act applies extra-territorially when output is used in the EU. If you sell SaaS used by EU customers, you are likely in scope.
"Our enterprise customers will handle compliance themselves." They will handle their deployer obligations. They cannot handle your provider obligations. They will, however, ask you to evidence your compliance, which is the same work.
"The Act will be watered down before enforcement." Possible but unlikely. The political consensus around the Act remains stable. Plan for it as written.
Bottom line
The EU AI Act is real and applies to Asian companies that touch EU markets or EU users. For most enterprise AI offerings the burden is moderate (limited or minimal risk class). For systems in the Annex III high-risk categories, the burden is substantial and the timeline is short.
If you are an Asian seller into Europe, do the inventory and classification work in the next quarter. The systems flagged as high-risk need 6-9 months of preparation. The systems flagged as limited-risk need transparency design. The systems flagged as minimal-risk need a documented analysis showing why they are minimal-risk. Doing none of this is not a strategy.
